Competition Under Water

Last news of 2012 from the Turkish Jurisdiction arrived in today. It is announced by the TCA that Investigation on Turkish Underwater Sports Federation (TUSF) has come to an end. During the investigation it was examined whether the TUSF abused its dominant position by exclusionary conducts. Alleged actions were that the TUSF had applied an obligation to pay an additional fee and submit additional documents for divers who had used educational systems other than CMAS.

As a result of the investigation, the Board decided that a violation by TUSF by abusing its dominant position via exclusionary practices against diving education systems other than CMAS system could not be detected. Consequently, it was concluded that the TUSF would not be imposed administrative fines.

I think this is an interesting decision which will show a proper way to distinguish between regulatory actions and economic actions of such associations. We will back on to that matter when the detailed decision is published.
